Litigation Partners Sarah Eichenberger and Nicholas Goldin, and Associate Jonathan Kaplan authored an article titled, “Maximizing Protection Over Sensitive Cyber Forensic Reports in Light of Recent Disclosure Orders,” which was published by New York Law Journal. The article provides an overview of recent case law concerning the discoverability of cyber incident reports in litigation, including instances in which courts have ruled that cyber reports are covered by the attorney-client privilege or work product doctrine, as well as instances in which courts have compelled disclosure of such reports. It concludes with suggestions to maximize the protection of cyber reports from third-party disclosure.
