Joshua Hazan Authors Article for ABA Antitrust Law Section Economics Committee Newsletter

Litigation Associate Joshua Hazan authored an article published in the Fall 2020 edition of the American Bar Association Antitrust Law Section’s Economics Committee Newsletter. Joshua provided an in-depth summary of a recent ABA panel titled, “Acquisitions of Potential Competitors: The U.S. Approach and Calls for Reform.” The discussion featured industry leaders sharing their perspectives on the need for intervention in acquisitions involving potential competitors, focusing on three main questions: (1) what should antitrust agencies and courts look for in evaluating the competitive effects of such acquisitions; (2) whether consumers have, in fact, been harmed by systematic under-enforcement by the antitrust agencies in such transactions and, if so, (3) whether the agencies and courts have the right tools to prevent anticompetitive acquisitions of potential competitors or whether reforms to the antitrust laws are necessary.
